Circular 10/10 – Facilitating SME participation in public procurement

It has been brought to our attention that many public bodies are not respecting or implementing the guidelines as set out in Circular 10/10. Entirely disproportionate requirements (for example as regards turnover and insurance) are still demanded in respect of low value and low risk tenders.

Many public bodies give the very minimum time within which to bid, even in respect of complex tenders involving significant risks. Sometimes, unsuccessful bidders rarely get adequate feedback about the relative strengths and weaknesses of their bids along with a complete explanation of their marks and how they were scored. So while Circular 10/10 is a very welcomed development, it needs to be implemented more robustly.
